Everfond Terms of Service

Welcome to Everfond. These Terms of Service ("Terms") are an agreement between you and the Everfond Team ("we", "us") for your use of the Everfond app. By using Everfond, you agree to these Terms. If you do not agree, please do not use the app.

1. What Everfond does

Everfond uses artificial intelligence to help you restore, enhance, and revive old photographs — clarifying faded faces and details, and (where offered) adding gentle color or motion.

2. Your content and your rights

You keep your photos. You retain all rights to the photos you choose and the restored results Everfond creates for you. We do not claim ownership of your images.
You confirm you have the right to use them. By restoring a photo, you confirm you have the right to use that image and that doing so does not violate anyone else's rights or any law.
Your memories live on your device. Restored results and saved memories are stored on your device. It is your responsibility to keep your own backups; deleting the app removes locally stored memories.

3. About AI restoration — please read

Everfond's restoration is performed by AI, and it is important you understand what that means:

A restored image is an AI's interpretation, not a perfect reproduction. The AI clarifies and reconstructs detail — including facial features — based on the original photo. It produces a *loving likeness*, which may differ in small ways from the original person or moment.
Restored images carry an "AI-restored" mark within the app to make this transparent.
Everfond restores and clarifies; it does not promise to remove every scratch, crease, or mark of age. Those marks are part of a photograph's history.
Because results are AI-generated interpretations, we cannot guarantee any specific outcome, accuracy, or likeness.

Please treat restored images with this understanding, especially for photos of people who are no longer with us.

4. Acceptable use

You agree not to use Everfond to:

Upload images you do not have the right to use.
Upload unlawful, abusive, or harmful content, or content depicting the exploitation of minors.
Attempt to misuse, reverse-engineer, overload, or circumvent the app or its services.
Use the app in violation of any applicable law.

We may suspend or limit access if the service is misused.

5. Subscriptions, free trials, and billing

Everfond offers a free tier and an optional Everfond Pro subscription that unlocks additional abilities (such as animation, colorization, and unlimited restorations).

Plans and pricing: Everfond Pro is offered as a Weekly plan at $6.99, including a 3-day free trial, and a Yearly plan at $49.99. There is no monthly plan. The prices shown in the app at the time of purchase always take precedence over this page.
Free trial: If a plan includes a free trial, you will not be charged if you cancel before the trial ends. If you do not cancel, the subscription begins automatically at the price shown.
Billing through Apple: All purchases are processed by Apple through your App Store account. Payment is charged to your Apple account at confirmation.
Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple ID / App Store subscription settings.
Refunds are handled by Apple according to the App Store's policies; we do not process payments directly and generally cannot issue refunds ourselves.

6. Third-party services

Everfond relies on third-party providers to function, including Apple (App Store, payments), RevenueCat (subscription management), and Replicate (AI photo processing). Your use of Everfond is also subject to those providers' terms where applicable. How we handle your data with these providers is described in our Privacy Policy.

7. Availability

We work to keep Everfond available and reliable, but we do not guarantee uninterrupted or error-free service. Features may change, and AI providers or models may be updated or replaced over time.

8. Disclaimers

Everfond is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and any guarantee regarding the accuracy, likeness, or quality of AI-restored images.

9. Limitation of liability

To the fullest extent permitted by law, the Everfond Team will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law (including, for consumers in the EEA/UK, your statutory rights).

10. Changes to these Terms

We may update these Terms as Everfond evolves. We will update the "Last updated" date and, for material changes, provide notice in the app. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the United Kingdom, without prejudice to mandatory consumer protections available to you in your country of residence.
